WHY do the courts believe the TG community does NOT deserve protection?

If The AVARAGE IQ among the TG community is 130 [borderline genius]… yet A new survey shows that 75 percent of transgender people in the Bay Area don't have full-time employment. Equally shocking: 58 percent make less than $15,333 a year.

Using a bit of basic math, that translates into…


You are OVER 1,500 times more likely to be murdered if you are a man in a dress.


Of the last 4 transgender homicides here in the greater Detroit/Ann Arbor MI Area:


ONE only ONE has been prosecuted... He turned himself in. The other three are not presently being actively investigated.

We are not protected because we have no established constitutional rights.American law is based on male and female and unfortunately we fall into the gray area of that.I would assume many of those who assume we are equally protected claim a Christian belief.I can't even begin to think of a time when I heard of someone being murdered for being Christian yet there is hate crimes protection for them.Ironically its the same people who are protected from hate crimes that say we are protected but who's beliefs are used as excuses for murdering us or failing to provide justice for our murders.Here is a link to show that are brains are female but our bodies aren't. http--www.symposion.com-ijtc0106.htm While I'm at it for the person who doesn't think where intelligent why don't you google lynn conway and check out her ts success page.It's easy to point out the high unemployment rate as an excuse to say where not intelligent but you must also look at the number of employers willing to try hiring us as employees.Right now I work for a custom home builder in a position of management in a finish trade I can have as many as ten employees or even more working for me at any given time.What do any of you think will happen to my job when its revealed that I am transexual.For all of you who think its okay to turn a blind eye towards the harm done to us or feel its okay to say where mental or perverted I feel sad for you and your lack of morals.If your going to accuse us of mental problems yet still pick on us or deny us work or fair protection what does that really say about you or your religious beliefs.
Reply:You mean extra special treatment? NO. I think they deserve the same treatment as everyone else. They are not better than anyone else. They already have protection just like everyone else.
Reply:I'm guessing that like other people who are unemployed, they haven't bothered to find jobs.
Reply:It's not that the TG community doesn't deserve protection -- but the statistics you are quoting are all about actions taken by other branches -- mainly executive agencies -- not the courts.





As to the core of your question -- it is because TG is not considered a protected class the way race and ethnicity and religion are -- and not even protected to the same degree that gender is. As a non-protected class, no special treatment.





I'm not saying it's right or wrong -- I'm answering your question about why the difference (or non-difference).
Reply:First and foremost, it is not the responsibility of the court to provide protection. The court is there to interpret established law.





Second, I doubt very seriously that the average IQ among transgenders is as high as you say. Unless you can provide unbiased, scientific evidence, I can't believe that, especially when you couple it with your next statistic. If a person is that intelligent, why then do they live so far below the poverty level. intelligence would dictate that they do something to change the equation. So either they are not that intelligent or they lack common sense.





What your statistics tell me is that being transgendered is not a productive choice.








To answer your additional details, nobody "DESERVES" more than equal protection under the law.

In the neighborhood I grew up in you ARE over 1,500 times more likely to be murdered if you are a man in a dress.





Maybe it's a paperwork thing. Prosecution gets hung up when it comes time to check the gender box - assuming that there is no block for 'Other'.





In reality the TG community, like the gay community, is nothing special.
Reply:Because the courts are not doing their job and never have. One of their jobs is to protect minorities from the tyranny of the majority. And even if their only job was to "interpret existing law" as one answerer suggested, existing law states, "All men are created equal." That's not too difficult for even a layman such as myself to interpret.
Reply:The statistic are correct. The reason that current laws do not protect us is due to the fact that "transgender people" are still viewed as "perversians" and are not deemed as moral people. This especially is true for M2F TG's because we live in a male dominated society. The most prevelent train of thought that most non-transgender people share is this, They cannot understand why a "man" would willingly wish to become female. "how could any man want his penis cut off?


Ther general public believe's that being "transgender" is a choice, and believing thus, the general public dosent try to really understand the truth about TG people.





We (the TG community) arent seen as "normal" and most people dont believe that we deserve equal rights.


Its up to us to make a stand and "fight for our rights" as Individuals.
